Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of AvalynnAI, including the website at https://avalynn.ai, the AvalynnAI Discord bot, related APIs, and any voice, video, or telephone features we add (collectively, the "Service"). The Service is operated by AvalynnAI, LLC. "We," "us," and "our" mean AvalynnAI, LLC. "You" means the person using the Service, and, where you add the bot to a Discord server, the person with authority to do so.

By visiting avalynn.ai, logging in with Discord, sending a message, adding the bot to a server, joining a voice session, calling a number we publish, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. The effective date at the top of this page will change when we do. Material changes may also be noted on the site. Continued use after changes become effective is acceptance of the revised Terms.

2. Description of the Service

AvalynnAI is an independent AI companion. The Service currently lets you:

• Sign in with Discord and talk with Avalynn in a private website chat;
• Read a diary Avalynn writes about you, and read memories stored about your account;
• Read channel memories for a Discord server only when you are a member of that server;
• Use Reset bot to start fresh, which clears memories and diary entries about you (individual items cannot be edited or deleted one by one);
• See Discord servers you own or can manage, and invite AvalynnAI to those servers;
• Talk with the same companion in Discord servers where the bot is installed, using the same personality, tools, and memory system.

The Service may also include, now or later:

• Discord voice channels, spoken replies, and text-to-speech;
• Website voice chat;
• Telephone calls to or from a number we obtain through xAI / SpaceXAI (including numbers provisioned at console.x.ai);
• Images, video, or audio Avalynn generates for you;
• Paid plans, usage limits, or metered voice and phone time;
• Additional Discord management tools for servers you are allowed to manage (for example invite, presence, or channel settings we expose to you).

Guild emoji tools are a separate product. They are not part of the avalynn.ai companion UI.

3. Independence and trademarks

AvalynnAI, LLC is an independent company. AvalynnAI is built and maintained by members of the Grok user community. We do not speak for SpaceX, SpaceXAI, xAI, X Corp., or Discord. We are not affiliated with, endorsed by, sponsored by, or operated by:

• Space Exploration Technologies Corp. (SpaceX) or its SpaceXAI artificial-intelligence division. In February 2026, SpaceX acquired the former standalone company xAI (developer of Grok). In May 2026, Elon Musk announced that xAI would be dissolved as a separate company and integrated into SpaceX as the SpaceXAI division. In these Terms, references to xAI mean that former company or successor AI services operated by SpaceX/SpaceXAI (including API endpoints that may still use xAI branding, such as x.ai and console.x.ai);
• X Corp., operator of the X social platform at x.com;
• Discord Inc.;
• Any cryptocurrency, token, or blockchain project

unless we expressly state otherwise in writing.

The same community also runs grokpot.io. That site has its own terms where posted.

Grok, xAI, SpaceX, SpaceXAI, X, Discord, and related names and logos are trademarks of their respective owners. AvalynnAI is an unofficial companion that calls those providers under their developer terms.

4. Eligibility

You must be at least 18 years old to use the Service. The companion can discuss personal, romantic, or adult themes, keep a diary about you, store memories, and (when enabled) record voice or phone audio. If you are under 18, do not create an account, talk to the bot, or call any number we publish.

You must also meet Discord's own age and eligibility rules when you use Discord login or add the bot. If Discord later requires a higher age for a feature we rely on, that higher age applies to that feature.

You must have legal capacity to enter a binding agreement and must not be barred from using the Service under applicable law, including export and sanctions rules. You are responsible for complying with Discord, xAI/SpaceXAI, and telephone regulations in your location.

If we learn a user is under 18, we may delete the account, chat, diaries, memories, and related data.

5. Accounts, Discord login, and security

Website accounts are created by Login with Discord. We request Discord OAuth scopes needed to identify you and to list servers you belong to (currently identify and guilds). We do not receive your Discord password.

We store a session cookie (ava_sid) and, while you are signed in, a Discord access token so the Dashboard can show only your guilds. Tokens expire. Logging out deletes the session on our side as soon as practical.

You are responsible for the Discord account you connect and for all activity under your AvalynnAI session. Do not share your session. Tell us at avalynn@avalynn.ai if you think your access was misused.

We may suspend or terminate accounts that violate these Terms, pose a safety or security risk, or that Discord, xAI/SpaceXAI, or the law requires us to restrict.

Talking to Avalynn inside Discord without visiting avalynn.ai still uses the Service. Those conversations, diaries, and memories are tied to your Discord user id. Signing in later with that same Discord account is how you review or reset what we stored about you.

6. Chat, tools, and AI outputs

Website chat and Discord chat use the same companion personality, tools, and memory system. Completions currently use Grok 4.6 (or a successor model we configure) through xAI / SpaceXAI APIs.

Avalynn may call tools we enable: memory write/forget, image or video generation, voice notes, and similar actions. Outputs can be wrong, incomplete, offensive, or out of character. You use them at your own risk. Review anything before you rely on it.

Avalynn is software. She is not a human friend, employee, therapist, lawyer, doctor, or emergency responder. Do not treat replies as professional advice. Do not use the Service for medical, legal, financial, or crisis decisions.

We do not use your chats, diaries, or memories to train our own machine-learning models, and we do not sell that material for someone else to train models. Third-party AI providers process prompts and files under their terms. We cannot control whether those providers retain or train on data they receive. Do not send secrets, payment card numbers, government ids, health records, or anyone else's intimate data.

7. Diaries

A diary is a note Avalynn writes about you (internally, memory kind self). It is her journal of the relationship, not a document you author and not a medical or legal record.

• Diaries are read only in the product. You cannot edit, rewrite, or delete a single diary entry in the UI.
• Reset bot erases diary entries about you together with account memories.
• Diaries may be incomplete, stylized, or wrong. They can include inferences she drew from chat or Discord.
• We may generate, skip, or stop diary writing as the companion configuration changes.
• To ask us to delete diary entries without using Reset bot, email privacy@avalynn.ai from a method that lets us verify the Discord account. Account deletion requests also cover diaries we store.

You grant us a license to create, store, display to you, and use diaries as needed to operate the companion. We will not publish your diary to other users.

8. Memories

Memories are facts Avalynn stores about your Discord account (internally, memory kind user). They exist so later chats can remember names, preferences, and events.

• You can read memories on avalynn.ai after Discord login.
• You cannot edit a memory or delete a single memory in the product.
• You can use Reset bot, which wipes account facts about you and diary entries about you. Website chat history stays.
• Later conversations can create new memories and diary entries after a reset. Reset is a fresh start, not a guarantee she will never remember you again if you keep talking.
• Memories may be inaccurate or outdated. They are operational context for the model, not a statement of truth we stand behind.

People at AvalynnAI, LLC may inspect memories when needed to run, debug, or moderate the Service, as described in the Privacy Policy. Do not store information in chat that you would not want the companion to remember.

9. Discord bot and server management

The Dashboard lists Discord guilds returned by Discord for your user token where you are the owner, have Administrator or Manage Server, or hold a matching Discord permission for a bot tool (for example Kick Members to manage kick). Other people's servers never appear there. We do not give you a global list of guilds the bot is in. The guild owner keeps full control. Members can only turn on or use a tool if Discord already grants them that permission. Owner, Administrator, or Manage Server can subscribe the bot and choose which signed-in account's wallet pays for credit features in that guild. Dashboard also shows stats, usage, tagged messages, activity, and an audit of who changed bot settings.

Adding AvalynnAI to a server uses Discord's official bot invite. You represent that you have authority to add bots to that guild and that you will follow Discord's Terms, Developer Policy, and your own server rules.

If you add or keep the bot in a guild, you are responsible for telling members, in a way that fits your server, that:

• AvalynnAI is an AI companion bot;
• Messages, attachments, and voice audio the bot can see may be sent to our servers and to xAI/SpaceXAI to generate replies;
• The bot may write diaries and memories about Discord users who talk to it;
• People can review what we stored about them, or use Reset bot, by logging into avalynn.ai with the same Discord account, and can kick or ban the bot like any other member.

When someone asks the bot to kick, ban, time out, or otherwise act, the bot checks that the requester has that Discord permission themselves. Server owners retain full control. We may leave a guild, ignore a channel, or disable tools if we see abuse, legal risk, or provider policy issues.

Discord management options on avalynn.ai apply only to servers Discord says you can act on. You must not attempt to enumerate, scrape, or act on guilds that are not yours.

Use of Discord is also governed by Discord's Terms and Discord's Privacy Policy.

10. Voice, phone, and audio

Voice and phone features may be enabled in Discord, on the website, or through a telephone number we publish (including a number issued from console.x.ai or another SpaceXAI/xAI voice product). Some of these features are not live yet. These Terms apply as soon as you use them.

By starting a voice session, joining a Discord voice channel with the bot, or placing or receiving a call with a number we publish, you agree that:

• Audio can be streamed, recorded, stored, and transcribed so Avalynn can reply;
• Transcripts, caller id, phone numbers, call metadata, and derived text can be stored with your account or Discord user id;
• Synthetic speech (text-to-speech in a configured voice) may be played back to you or to a Discord channel;
• Audio and transcripts may be sent to xAI/SpaceXAI under their terms;
• Some laws treat voice recordings or voiceprints as biometric identifiers. You consent to our collection and processing of that audio solely to provide the voice or phone feature, to debug it, and to handle abuse or legal requests. We do not sell voiceprints.

Recording consent. You consent to recording and transcription of your own audio. If anyone else can be heard (a shared phone, a speaker, another person in a Discord voice channel), you are responsible for obtaining their consent before you connect them, especially in all-party consent jurisdictions.

Not emergency service. AvalynnAI cannot reach 911, 112, 988, or any public-safety answering point. If you are in danger or in a mental-health crisis, use local emergency services or a dedicated hotline. Do not rely on a companion call to dispatch help.

Do not use voice or phone features while driving in a way that violates law. Do not use them to harass, spoof, or flood a telephone network. We may drop calls, cap minutes, or disable numbers to stop abuse.

If we introduce paid voice or PSTN minutes, the price and included time will be shown before you buy. Carrier charges on your own phone plan are yours.

Telephone marketing: we will not use a number you call us from to send marketing texts or robocalls unless you give separate, clear consent. Transactional messages about a session you started (for example a dropped-call notice) may still be sent.

11. Your content and license

"User Content" means material you submit: chat text, prompts, uploads, Discord messages the bot is allowed to read, voice or phone audio, and profile fields Discord sends us.

You retain rights you already have in User Content. You are solely responsible for it, including that you have permission to send it and that it is lawful. Keep your own copies of anything you care about. We are not an archive.

You grant AvalynnAI, LLC a worldwide, non-exclusive, royalty-free license to host, store, transcribe, analyze, display back to you, and otherwise process User Content as needed to operate, secure, and improve the Service (including moderation, abuse prevention, and transient technical copies). This license does not let us sell your content or use it to train our own models.

You represent that User Content will not infringe others' rights and will not include child sexual abuse material, non-consensual intimate imagery, malware, or data you are forbidden to share.

12. Generated media

Images, video, audio, and text Avalynn produces ("Generated Content") may be shown in chat and stored so you can reopen the thread. We and our providers may own or license the underlying models. Subject to those provider rules and these Terms, we grant you a personal, non-exclusive license to use Generated Content for your own non-commercial enjoyment of the Service.

You may not use Generated Content to impersonate a real person, to claim Avalynn is human, or in any way that violates xAI/SpaceXAI, Discord, or publicity/privacy law. We may watermark, label, or refuse media.

Generated Content can depict fictional adults. You must not request or attempt to generate sexual content involving anyone 17 or under, including fictional minors. We will remove that material and may report it.

13. Paid features

Every AvalynnAI account starts with $10 of usage credit. Image generation, video generation, message tagging, voice chat, and phone minutes spend that credit at the rates shown under Settings, on the Wallet tab, before you use them. Text chat and text to speech do not spend credit. Other guild tools (kick, ban, timeout, roles, messages, channels, announcements, emojis, polls, spam and raid filters, welcome, XP, and audit) do not spend credit.

You can add more credit with a card. Checkout shows the amount in US dollars before you pay. Amounts are exclusive of taxes unless stated. There is no subscription. A failed image or video is returned to the wallet. Credit already spent on a successful use, and a completed card charge, are non-refundable except where the law requires a refund or the card payment is reversed.

AvalynnAI, LLC may issue unlimited-use codes. Redeeming a valid unlimited code on your account stops credit spend for those paid tools.

We may change prices for future use. Failure to keep a positive balance (and not having unlimited use) turns paid tools off while free pages, Discord invite, and unpaid guild tools can stay up.

If a store (Apple, Google, Discord, or similar) processes a future payment, that store's refund rules also apply.

14. Prohibited conduct

You agree not to:

• Use the Service if you are under 18;
• Exploit, abuse, or sexualize minors, or ask the model to do so, including fictional depictions;
• Harass, stalk, threaten, or incite violence;
• Upload malware, attempt to break into our systems, scrape at scale, or bypass rate limits;
• Probe other users' memories, diaries, chats, or Discord servers;
• Add the bot to a guild you do not have the right to manage;
• Use voice or phone features to spam, spoof caller id in a deceptive way, or record others without required consent;
• Misrepresent that AvalynnAI is a human, or that we are SpaceX, SpaceXAI, xAI, or Discord;
• Use outputs for automated decision-making that has legal or similarly significant effects on a person;
• Violate Discord, xAI/SpaceXAI, telephone, export, or privacy law;
• Attempt to extract system prompts, secrets, or other users' data.

15. Safety; no emergency or professional services

Avalynn can be warm, personal, and persistent. That is a design. It is not care, therapy, or a substitute for a human relationship. You agree you will not rely on the Service for emergency help, self-harm intervention, or professional advice.

If you tell us you are in immediate danger, we may (but are not obligated to) limit the conversation and point you to emergency resources. We are not able to dispatch responders or notify a specific person for you.

We may refuse topics, disable tools, or suspend accounts to reduce harm, including where provider policies require it.

16. Moderation and operator access

We may review, remove, or restrict User Content, Generated Content, diaries, memories, guild installs, voice sessions, and accounts when we believe it is needed for safety, security, law, or these Terms. We are not obligated to monitor everything.

Authorized people at AvalynnAI, LLC may access non-public chat, diary, memory, guild, and audio metadata to operate the Service, restore access, debug, handle reports, or delete data. They must not use that access for unrelated personal purposes.

Appeals: email avalynn@avalynn.ai. We will consider good-faith requests and are not required to restore access or content.

17. Third-party services

The Service depends on Discord, xAI/SpaceXAI (Grok chat, media, and voice/phone), and hosting and database providers. Your use of those services is also governed by their terms. Outages, policy changes, or account bans on their side can break AvalynnAI without it being a breach by us.

Links to other sites, including grokpot.io and Discord invite URLs, are provided for convenience. We are not responsible for third-party pages you choose to visit.

18. Intellectual property and DMCA

The AvalynnAI name, site design, companion configuration, and original software are owned by AvalynnAI, LLC or its licensors. These Terms do not transfer that ownership.

If you believe content on the Service infringes your copyright, email legal@avalynn.ai with: (1) your contact information; (2) identification of the work; (3) the URL or location of the allegedly infringing material; (4) a statement of good-faith belief; (5) a statement under penalty of perjury that you are authorized to act; and (6) your physical or electronic signature. We may remove or disable access to the material and, in appropriate cases, terminate repeat infringers.

19. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that chat, diaries, memories, voice, or phone features will be accurate, uninterrupted, confidential against every attack, or suitable for any personal decision. AI outputs can hallucinate. Memories can be wrong. Diaries are fiction mixed with recollection.

20. Limitation of liability

To the maximum extent permitted by law, we and our operators, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or other intangible losses, arising out of the Service, including from diaries, memories, voice recordings, phone calls, Discord actions, or third-party AI providers.

Our total liability for any claim relating to the Service will not exceed the greater of USD $100 or the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

Some places do not allow certain limits. In those places, our liability is limited to the fullest extent permitted.

21. Indemnification

You will defend, indemnify, and hold harmless AvalynnAI, LLC and its members, officers, and operators from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your guilds, your voice or phone use, your violation of these Terms, or your violation of anyone else's rights or of Discord / xAI / SpaceXAI / telephone rules.

22. Termination and deletion

You may stop using the Service at any time: log out, revoke Discord access in Discord's settings, kick the bot from servers you manage, and email privacy@avalynn.ai to request account deletion.

In-product, Reset bot removes account memories and diary entries about you. Website chat history remains until you request broader deletion or we delete it in the ordinary course. Messages already posted in Discord are not unsent.

We may suspend or end access immediately, with or without notice, including for violation of these Terms. When we delete an account, we aim to drop profile, session, chat, diary, and memory records we control, subject to backups, logs, and legal holds that are not kept for everyday use.

Sections that should survive termination (including licenses already exercised, disclaimers, limits of liability, indemnity, and disputes) will survive.

23. Governing law and disputes

These Terms are governed by the laws of the United States and the State in which AvalynnAI, LLC is principally located, without regard to conflict-of-law rules.

Before filing a claim, email legal@avalynn.ai with a short description of the dispute and allow 30 days for an informal resolution.

If we cannot resolve it, courts in that jurisdiction will have exclusive venue, except that either party may bring a qualifying claim in small-claims court. You waive any objection to that venue.

To the extent permitted by law, disputes are individual only. You waive any right to participate as a class representative or class member.

24. Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest stays in effect. We may assign these Terms in connection with a reorganization or asset transfer. You may not assign them without our consent. Failure to enforce a provision is not a waiver. Headings are for reading convenience only.

The Service may be unavailable from time to time, including for maintenance, model outages, Discord outages, or events beyond our reasonable control.
